Message to all Owners,

In our report Irma #8, we stated the following concerning Florida rooms that were damaged by the hurricane: “The owners of these units should take the opportunity to replace their damaged roofs with ones that comply with the Florida building code.”

In our report Irma #10, we provided a list of the condominiums with damaged Florida rooms and the type or extent of damage sustained by each.

The Board of Directors has an obligation to ensure that owners comply with applicable laws and regulations concerning such matters. The Board has confirmed with the Town of Hypoluxo that an owner must obtain a permit from the Building Department before making repairs to a Florida room, even though the damage was caused by a hurricane. In addition, the Town Inspector has confirmed that a corrugated plastic roof is NOT an acceptable material under the provisions of the Building Code.

Please note that the Permit Application for the Town of Hypoluxo specifically requires an owner “… to certify that no work or installation has commenced prior to the issuance of a permit and that all work will be performed to meet the standards of all law regulating construction in this jurisdiction.”

We strongly emphasize the obligation of owners to comply with the requirements of the Building Code of the Town of Hypoluxo and to obtain a permit. Licensed contractors are well aware of this requirement. An owner who fails to obtain a permit from the Building Department of the Town of Hypoluxo before the repairs begin is subject to the imposition of a fine by the Town of Hypoluxo.

The Permit Application is available from the Town of Hypoluxo or online at hypoluxo.org and appears in the list of forms as “General Permit Application”.

Nous invitions les propriétaires dans notre communiqué Irma #8 à remplacer ou réparer leur « Florida Room » avec des matériaux conformes au code du bâtiment applicable à l’état de Floride. »

Dans notre communiqué Irma #10, nous vous avons transmis une liste des unités dont les « Florida Room » avaient été endommagés et précisé le type de dommage encouru.

Votre conseil d’administration a le devoir de s’assurer que les propriétaires respectent les lois et règlements en vigueur en pareille matière. À cet égard, la ville d’Hypoluxo nous a confirmé qu’il est vous est nécessaire d’obtenir un permis, même si les dégâts sont causés par un ouragan, avant d’entreprendre les travaux de réparation. De plus, le code du bâtiment doit trouver application et celui-ci ne permet pas l’installation de panneaux de plastique ondulé.

.Nous attirons particulièrement votre attention sur l’obligation qui vous est imposée de certifier qu’aucun travail n’a été entrepris avant que le permis ne soit émis et que les travaux envisagés rencontreront les normes établies par la loi et la règlementation applicable.

Nous vous enjoignons  de vous conformer à la réglementation et de vous assurer que le code du bâtiment est correctement appliqué. Nous sommes également assurés que les entrepreneurs qui effectuent ce type de travail dans notre communauté connaissent bien informés ces exigences. Vous devrez respecter ces mêmes règles même si vous décidiez de faire le travail vous-même. Dans l'hypothèse contraire, sachez que vous vous exposez aux pénalités que la Ville pourra vous imposer.

Le formulaire de permis est disponible à l’hôtel de Ville d’Hypoluxo ou sur le site hypoluxo.org et apparait dans une liste de formulaires « General Permit Application. »
